Auto Insurance Requirements in Nevada
Nevada requires drivers to carry minimal insurance coverage of 25/50/25, which means:
- $25,000 bodily injury liability coverage per person
- $50,000 bodily injury liability coverage per accident
- $25,000 property damage liability coverage per accident
The driver who hit you should at least have this amount of insurance coverage to pay for your damages, or else they are breaking the law whenever they drive. This minimal coverage amount might not pay for all your damages, though, so we can explore the possibility of filing against other policies held by the driver who hit you. MedPay or uninsured/underinsured motorist (UM/UIM) insurance policies that you purchased from your insurance company can also be considered.
Can You Sue If You Were Partially at Fault?
Nevada has a comparative fault system for deciding liability in a car accident with a 50% modifier. As long as you are not more than 50% at fault for your car accident, you can file a claim against the other party or parties and demand a financial recovery.
Your percentage of liability will reduce the recovery you receive by an equal percentage, though. For example, you are owed $100,000 in damages but you are 30% at fault for the crash. In this case, you could possibly recover $70,000, which is $100,000 minus 30%.
